1. PRIVACY COMMITMENT

Mithomi: Look, Think and Draw has been designed under the fundamental principle of privacy by default (Privacy by Design). The Developer does not collect personal data of any kind, does not track your activity under any circumstances, and does not have access to identifiable user information.

This Application has been developed in accordance with general privacy and data protection principles and operates entirely autonomously on your device.

2. LOCAL PROCESSING (ON-DEVICE)

All game processing, including game logic, game progress, statistics, scores, settings, and the token system, is performed exclusively on your own device. Your game data never leaves your device and is never transmitted to any external server, cloud service, or third party.

Subscription Verification: The Application may require an internet connection solely to communicate with Apple services (App Store) for the purpose of verifying the User's subscription status (active, expired, plan type). This verification is managed exclusively by Apple Inc. and does not involve the Developer's servers. The Developer does not have access to the data transmitted during this verification process.

Multimedia Content: Game resources include third-party licensed music and sound effects for exclusive use within the Application. These resources do not contain or collect user data.

This means that:
• There is no network communication related to your game progress, statistics, scores, or settings.
• No game data is stored on the Developer's servers.
• No intermediary has access to your game information.
• Game resources (figures, visual themes, effects) are included in the Application and do not require an internet connection to function.

3. ZERO DATA COLLECTION

This Application DOES NOT collect, store, transmit, or process on external servers any of the following data:
• Personally identifiable information: name, email address, phone number, address.
• Game data: progress, statistics, games played, scores, levels completed, personal settings, resources, available tokens.
• Diagnostic data, crash logs, or usage telemetry generated by the App.
• Advertising identifiers (IDFA) or cross-app tracking data.
• Geographic location data (GPS or any other method).
• Device information such as model, operating system version, or unique identifiers.
• Behavioral data, usage patterns, gameplay preferences, or analytics of any kind.
• Drawings created by the user during gameplay.

The Application DOES NOT incorporate third-party analytics tools, external advertising networks, or user behavior tracking systems.

The Developer reserves the right to incorporate anonymous analytics tools or third-party services in the future for the purpose of improving the stability and operation of the Application. If any such tools or services are incorporated, this Privacy Policy will be updated. Users are encouraged to review this Policy periodically.

4. DATA COLLECTED BY APPLE

Apple Inc. may automatically and independently collect certain anonymous system diagnostic and telemetry data through the App Store and the iOS operating system, regardless of the Application's distribution phase. This collection is managed exclusively by Apple and is subject to Apple's Privacy Policy (apple.com/privacy).

The Developer of Mithomi: Look, Think and Draw does not have access to this data, does not control it, and does not participate in its collection or processing. This data never reaches the Developer's servers.

Such Apple data may include, subject to Apple's own policies:
• System crash reports (anonymous crash reports).
• Technical device performance data.
• Operating system diagnostic information.

5. SUBSCRIPTION AND PAYMENT MANAGEMENT

5.1 Payment Processing

Mithomi: Look, Think and Draw offers in-app subscriptions. Payment processing and subscription management are handled entirely by Apple Inc. through the App Store. The Developer does not receive, process, store, or have access to your financial data, credit card information, or billing information.

5.2 Access Options

FREE BASE MODE: The Application allows gameplay through a token system in which tokens regenerate over time. Users of the base mode will see advertisements for other applications from the same Developer.

SUBSCRIPTIONS: Subscriptions provide unlimited tokens, removal of advertisements, and access to additional features during the active subscription period. Subscriptions may have different durations (monthly or annual) and benefits. The specific content and benefits included in each plan may be modified at any time without prior notice.

5.3 Renewal and Cancellation

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You may manage, restore, or cancel your subscription at any time from your iOS device settings under Settings > [your name] > Subscriptions.

If a subscription expires or is canceled, access to premium features will no longer be available, but progress and settings previously saved on your device will remain accessible in base mode.

The Developer reserves the right to modify, at any time, the content, features, or benefits included in any subscription option, without prior notice. Subscription prices may be changed at any time.

For any questions related to payments, renewals, or refunds, you must contact Apple directly through reportaproblem.apple.com.

6. ADVERTISEMENTS

Users without an active subscription that includes ad removal will see advertisements for other applications published by the same Developer.

These advertisements:
• Are created and managed directly by the Developer, NOT by third-party advertising networks.
• DO NOT use advertising identifiers (IDFA) or cross-app tracking systems.
• DO NOT track user behavior or collect personal data.
• DO NOT require or request App Tracking Transparency (ATT) permission.
• May appear in different locations within the Application.

The Developer reserves the right to modify, at any time and without prior notice, the format, placement, frequency, quantity, and presentation of the advertisements displayed.

Advertisements are automatically hidden for users with an active subscription that includes this feature.

Advertised Applications as Independent Products: The advertised applications are independent products, each with its own features, terms of use, and privacy policies. The Developer assumes no responsibility whatsoever for the content, operation, availability, or any other aspect related to the advertised applications. By interacting with the advertisements and downloading or using any of the advertised applications, the User agrees to be bound by the specific terms and privacy policies of each application. Users are encouraged to review the terms and policies of each application before using it.

The display of additional information about advertised applications may be managed through Apple Inc. services (such as the App Store) and is subject to Apple's privacy policies.

7. LOCAL DATA STORAGE

The Application may store certain game data in the device's secure storage system in order to preserve:
• Game progress and completed levels.
• Statistics and personal records.
• Settings and preferences (selected visual theme, haptic options, subscription status, etc.).
• Token system status.
• Saved game progress.

This data:
• Contains only information related to the game state.
• DOES NOT contain personal or identifiable user information.
• Is stored in encrypted form using Apple's security system.
• May be automatically synchronized between the User's devices if the User has enabled Apple's synchronization services.
• May include information about the User's subscription status (active/inactive, expiration date, plan type) stored locally and synchronized through iCloud Keychain to maintain consistency across devices linked to the same Apple ID.
• Is managed by Apple's security system and is subject to Apple's Privacy Policy (apple.com/privacy).

The Developer does not have remote access to this data. This storage is used solely to maintain persistent game continuity across sessions and devices linked to the same Apple ID used by the User.

8. AUDIENCE AND AGE RATING

Mithomi: Look, Think and Draw is designed for a general audience and is not specifically directed at children or any particular age group.

The Application's age rating is determined and displayed by Apple through the App Store rating systems, based, among other factors, on the information provided by the Developer in App Store Connect and the criteria applicable in each country or region.

The Application does not require the creation of a user account and operates locally on the device. The Developer does not intentionally request, collect, store, or transmit users' personal information, including information from minors. Likewise, the Application does not create user profiles or store personal information on servers or cloud services operated by the Developer.

Because Mithomi: Look, Think and Draw operates entirely locally, without any type of user registration or data collection, use by minors does not generate profiles, cloud storage, or any type of identifiable data. Nevertheless, minors are advised to use this Application under the supervision of a responsible adult.

9. SECURITY OF YOUR DATA

Because all information remains on your device at all times, the security of your game progress, scores, tokens, and settings depends on the protections Apple provides for the iOS operating system (device encryption, Face ID / Touch ID, etc.) and on the measures you take yourself.

The Developer recommends:
• Keeping your device updated to the latest version of iOS.
• Enabling password or biometric protection on your device.
• Making periodic backups through iCloud or iTunes.

10. LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES

This Application is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Because all processing occurs locally on your device, the User is solely responsible for safeguarding and backing up their game progress, tokens, settings, and statistics. The Developer assumes no responsibility for:
• Loss of game progress, scores, tokens, resources, or settings resulting from hardware or operating system failures.
• Accidental deletion of data by the User.
• Direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Application.
• Loss or alteration of game data caused by updates to the Application or the iOS operating system.
• The content of third-party websites or applications that may be accessed from the App (such as advertised applications).
• Service interruptions, errors, or any other element that may affect the User's device.
• Any claim arising from use of the Application.
• Inaccessibility of synchronized data due to causes attributable to Apple or to the configuration of the User's account.
• Loss, corruption, failure to synchronize, or any issue related to locally stored data due to problems with Apple services, changes to the User's account, or any other cause beyond the Developer's control.

The Developer does not guarantee that Application updates:
• Will maintain compatibility with the User's existing progress, settings, or data.
• Will not introduce new errors or issues.
• Will improve performance on all devices.
• Will be compatible with future versions of iOS or specific device models.

The User agrees that installing updates is at their own risk and that the Developer will not be liable for data loss, incompatibilities, or operational issues resulting from updates to the Application or the operating system.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the Developer's total liability to the User shall in no event exceed the lesser of: (a) the amount actually paid by the User for subscriptions during the twelve (12) months preceding the event giving rise to the claim, or (b) USD $10.00 (ten United States dollars). For further details regarding limitations of liability, please refer to the Application's Terms of Use.

11. CHANGES TO THIS POLICY

The Developer may update this Privacy Policy from time to time to reflect changes to the Application, applicable law, or industry practices, including the possible future incorporation of analytics tools or third-party services.

Any changes will be reflected by updating the "Last updated" date at the beginning of this document. Users are encouraged to review this Policy periodically. Continued use of the Application after changes are posted constitutes acceptance of the updated Policy.

12. JURISDICTION AND GOVERNING LAW

This Privacy Policy is governed by the laws of the Plurinational State of Bolivia. Any dispute arising from the use of this Application shall be submitted to the competent courts of Bolivia.

Notwithstanding anything set forth in this Policy, the User retains all rights granted under the consumer protection laws of the Plurinational State of Bolivia that cannot be contractually limited or waived.

13. OFFICIAL LANGUAGE AND TRANSLATIONS

This Privacy Policy was originally drafted in Spanish. It may be translated into other languages for the User's convenience. In the event of any discrepancy, ambiguity, or conflict between the Spanish version and any translation, the original Spanish version shall prevail in all cases.

The Spanish version is the only legally binding version and the only version having official effect before any court, authority, or legal proceeding.

The User expressly acknowledges and declares that:
• The User has had access to the Spanish version of this Privacy Policy.
• The User has read and understood the Spanish version, or has had a reasonable opportunity to obtain assistance in understanding it.
• The User agrees that the Spanish version is the only legally binding version.
• The User waives any claim based on inaccurate, incomplete, or erroneous translations into other languages.
• Any automatic, unofficial, or third-party translation is not the responsibility of the Developer and may contain errors or inaccuracies.

If the User does not understand Spanish, it is the User's responsibility to obtain professional translation assistance before using the Application. Continued use of the Application constitutes acceptance that the Spanish version of this Policy is the official and binding version.
