PRIVACY POLICY SimplyMark Last Updated: May 15, 2026 1. PRIVACY COMMITMENT SimplyMark has been designed under the fundamental principle of Privacy by Design. The developer has no access to your images or files, does not collect personal data of any kind, and does not track your activity under any circumstances. This application has been developed respecting general principles of privacy and data protection, and operates completely autonomously on your device. 2. LOCAL PROCESSING (ON-DEVICE) All image processing, including text and image overlay, is performed exclusively on your own device using iOS operating system technology. Your images and files never leave your device nor are they transmitted to any external server, cloud, or third party. This means that: • There is no network communication related to your images or files. • No images or multimedia content are stored on the developer's servers. • There is no intermediary with access to your content. • The open-source fonts included in the application do not require an internet connection for use. 3. ACCESS TO DEVICE RESOURCES The application may request access to the following device resources, always for specific purposes and under your explicit control: Photo Library: • To allow you to select the image you wish to edit. • To save the processed result to your photo roll, only if you explicitly request it. File System ("Files" app): • To export text templates that you have created and saved within the application, in order to preserve them outside the app. • To import previously exported templates, for example after reinstalling the application. These accesses are managed entirely by the iOS operating system and are subject to permissions you explicitly grant. The developer has no visibility whatsoever over the content of your photo library or your files. You can revoke these permissions at any time from Settings > Privacy & Security on your device. Regarding iCloud storage: if you choose to save your exported templates to iCloud through the "Files" app, such storage and synchronization are managed exclusively by Apple Inc. and are subject to Apple's Privacy Policy (apple.com/privacy). The developer of SimplyMark has no access to those files, does not store them on their servers, and does not participate in their management. 4. ZERO DATA COLLECTION This application DOES NOT collect, store, transmit, or process on external servers any of the following data: • Personal identification information: name, email, phone number, address. • Images, photos, or any multimedia content from your device. • Templates, texts, or files exported or imported by the user. • Diagnostic data, crash logs, or usage telemetry generated by the app. • Advertising identifiers (IDFA) or cross-app tracking data. • Geographic location data (GPS or other method). • Device information such as model, operating system version, or unique identifiers. • Behavioral data, usage patterns, or analytics of any kind. The application DOES NOT incorporate third-party analytics tools, external advertising networks, or user behavior tracking systems. The developer reserves the right to incorporate anonymous analytics tools or third-party services in the future. Should such incorporation occur, this Privacy Policy will be updated prior to its implementation, as described in section 11. 5. DATA COLLECTED BY APPLE Apple Inc. may automatically and independently collect certain anonymous diagnostic and telemetry data from the system through the App Store and iOS operating system, regardless of the application's distribution phase. This collection is managed exclusively by Apple and is subject to Apple's Privacy Policy (apple.com/privacy). The developer of SimplyMark has no access to this data, does not control it, and does not participate in its collection or processing. This data never reaches the developer's servers. This Apple data may include, according to their own policies: • Anonymous system crash reports. • Technical device performance data. • Operating system diagnostic information. SUBSCRIPTION — PURCHASE MANAGEMENT SimplyMark offers a free mode with limited functionality and a subscription model for full access. Payment processing and subscription management are handled entirely by Apple Inc. through the App Store. The developer does not receive, process, store, or have access to your financial data, credit card information, or billing data. Free Mode: The application allows use of the complete editor and export of a limited number of watermarked images per day. Free mode users will see promotions for other applications by the same developer, as described in section 6.1. Pro Mode (Subscription): The subscription removes daily export limitations, removes the watermark from exported images, and hides promotions. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage, restore, or cancel your subscription at any time from your iOS device settings. Feature access: Premium features (also called PRO) of the application require an active subscription. If the subscription expires or is canceled, access to such features will no longer be available and the user will return to free mode with its corresponding limitations. Previously edited and saved images on your device will remain accessible. Price changes: Subscription prices may be modified at any time. Apple Inc. may notify such changes through the App Store according to their own policies. For any inquiries related to payments, renewals, or refunds, you should contact Apple directly through reportaproblem.apple.com. 6.1 CROSS-PROMOTION Free mode users will see promotions for other applications published by the same developer. These promotions: • Are created and managed directly by the developer, NOT by third-party advertising networks. • DO NOT use advertising identifiers (IDFA) or cross-app tracking systems. • DO NOT track user behavior or collect personal data. • DO NOT require or request App Tracking Transparency (ATT) permission. • May appear in different locations within the application. The developer reserves the right to modify, at any time and without prior notice, the form, location, frequency, quantity, and presentation of promotions shown to free mode users. Promotions are automatically hidden for users with an active subscription. Independent Promoted Applications: The promoted applications are independent products, each with their own functionalities, terms of use, and privacy policies. The developer assumes no responsibility whatsoever for the content, operation, availability, or any aspect related to the promoted applications. By interacting with the promotions and downloading or using any of the promoted applications, the user agrees to be subject to the specific terms and privacy policies of each application. Users are advised to review the terms and policies of each application before use. The display of additional information about promoted applications may be managed through Apple Inc. services (such as the App Store) and is subject to Apple's privacy policies. 6.2 SYNCED KEYCHAIN STORAGE For free mode users, the application stores a daily export counter in the device's synced Keychain. This counter: • Contains only numerical information (number of exports performed and date). • DOES NOT contain images, personal content, or user-identifiable information. • Is stored in encrypted form through Apple's security system. • May automatically sync across the user's devices if iCloud Keychain is enabled. • Is managed by Apple's security system and is subject to Apple's Privacy Policy (apple.com/privacy). The developer has no remote access to this counter. Synchronization via iCloud Keychain is managed exclusively by Apple Inc. and requires the user to have iCloud Keychain enabled on their device. This storage has the sole purpose of maintaining the daily export limit persistently and preventing it from being circumvented by reinstalling the application. 7. USER-GENERATED CONTENT AND USAGE RESPONSIBILITY SimplyMark is an image editing tool that allows users to overlay text and images on their own photographs, as well as create and manage custom text templates. The user is solely and exclusively responsible for the content they use, create, and distribute through this application. The developer is not responsible under any circumstances for: • The use of images, logos, trademarks, fonts, or other elements over which the user does not possess the corresponding intellectual or industrial property rights. • Violation of copyrights, trademarks, image rights, or other third-party rights arising from the use of the application. • The use of the application to create false, misleading, defamatory, fraudulent content, or content that violates applicable law. • The distribution or publication of content generated through the application on third-party platforms. • Any claim, demand, damage, or harm originating from content created with the app, including third-party claims for misuse of their intellectual or industrial property. • The loss, corruption, or inaccessibility of exported templates due to factors external to the application, including operating system changes, app uninstallation, or modifications to the user's iCloud account. The user declares and warrants that they possess all necessary rights over the content they use with this application, or that they have the appropriate authorizations to do so. The developer assumes no responsibility whatsoever for non-compliance with this declaration. 8. CHILDREN'S PRIVACY This application is not directed at children under 13 years of age. The minimum age may vary by country and is automatically determined by the Apple App Store according to applicable local legislation. The developer does not knowingly request or collect personal information from minors. Since SimplyMark operates completely locally and without any type of user registration or data collection, use by minors does not generate profiles, cloud storage, or any type of identifiable data. However, it is recommended that minors use this application under the supervision of a responsible adult. 9. DATA SECURITY Since all information remains on your device at all times, the security of your images and templates depends on the protection that Apple provides to the iOS operating system (device encryption, Face ID / Touch ID, etc.) and the measures you yourself adopt. The developer recommends: • Keeping your device with the most recent version of iOS. • Activating password or biometric protection on your device. • Periodically exporting and backing up your templates if you wish to preserve them long-term. • Performing periodic backups through iCloud or iTunes. 10. LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES This application is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Since everything is processed locally on your device, the user is solely responsible for the custody and backup of their edited images and saved templates. The developer assumes no responsibility for: • Loss of images or templates resulting from hardware or operating system failures. • Accidental deletion of photos or files by the user. • Direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the application. • Loss or alteration of locally saved images or templates caused by application or iOS operating system updates. • The content of third-party websites or applications that may be accessed from the app. • Service interruptions, errors, or any other element that could affect the user's device. • Any claim arising from content created with the application. • The inaccessibility of templates exported to iCloud due to causes attributable to Apple or the user's account configuration. • The loss, corruption, lack of synchronization, or any problem related to the export counter stored in the synced Keychain, due to problems with iCloud Keychain, changes to the user's iCloud account, or any other cause beyond the developer's control. To the maximum extent permitted by applicable law, the developer's total liability to the user shall not exceed in any case the amount actually paid by the user during the last 12 months of subscription. CHANGES TO THIS POLICY The developer may occasionally update this Privacy Policy to reflect changes in the application, applicable legislation, or industry practices, including the potential incorporation of analytics tools or third-party services as indicated in section 4. When significant changes are made, notification will be provided through: • Updating the "Last Updated" date at the beginning of this document. • A notification within the application in the next available update. It is recommended to review this policy periodically. Continued use of the application after publication of changes implies acceptance of the updated policy. 12. JURISDICTION AND APPLICABLE LAW This Privacy Policy is governed by the laws of the Plurinational State of Bolivia, without prejudice to additional rights the user may have under the legislation of their country of residence. Any dispute arising from the use of this application shall be submitted to the competent courts of Bolivia. 13. OFFICIAL LANGUAGE This Privacy Policy was originally written in Spanish. It may be translated into other languages for user convenience. In case of discrepancy, ambiguity, or conflict between the Spanish version and any translation, the original Spanish version shall prevail in all cases. 14.
