TERMS OF USE STAY COMPRESS Last updated: May 14, 2026 IMPORTANT NOTICE: BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THIS APPLICATION, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE WITH ANY OF THEM, DO NOT USE THE APPLICATION. 1. ACCEPTANCE OF TERMS By downloading, installing, accessing, or using Stay Compress ("the Application"), you ("the User") agree to be legally bound by these Terms of Use ("the Terms"), including the Privacy Policy available at https://stayarts.com/staycompress/privacy. If you do not agree with any of these terms, do not use the Application. Continued use after any update to the Terms implies acceptance thereof. These Terms constitute the complete agreement between you and the Developer regarding the Application, and supersede any prior verbal or written agreement. 2. SERVICE DESCRIPTION Stay Compress is an image compression application for iOS that allows Users to reduce the size of their images through quality, resolution, format, and metadata management adjustments. The Application allows compressing images to JPEG format (through quality and scale reduction) or PNG (through scale reduction only). The Application operates exclusively through local processing on the User's device, using native Apple technologies. The Application DOES NOT transmit, collect, or store on external servers any image, personal data, or User metadata. All processing occurs entirely on your device. Any technical data collected by Apple Inc. through their platforms (such as App Store or TestFlight) is managed exclusively by Apple according to their own policies, and never reaches the Developer's servers. The Developer reserves the right to modify, suspend, or discontinue any functionality of the Application at any time, with or without prior notice, without incurring any liability to the User. 3. SUBSCRIPTION 3.1 Subscription Model and Features The Application offers basic functionality for free with certain limitations. Free users have limited access that includes: • Limited image export (subject to daily limits established by the Developer). • Limited selection of simultaneous images. • Display of promotions for other developer applications within the Application interface. The PRO subscription removes these limitations and provides full access to all premium features, including: • Unlimited image export without daily restrictions. • Selection of multiple images simultaneously for batch processing. • Completely promotion-free and ad-free experience within the Application. • Priority access to new features and improvements. The Developer offers subscription plans whose prices are displayed in the App Store according to the User's region at the time of purchase. The Developer reserves the right to modify subscription plan prices at any time and in accordance with Apple policies. The price in effect at the time of subscription is applicable until the next renewal. The Developer reserves the right to modify, add, or remove limitations for free users, as well as modify PRO subscription benefits, at any time and without prior notice, through Application updates. 3.2 Automatic Renewal Subscriptions automatically renew at the end of each period (monthly or annual), unless the User cancels at least 24 hours before the end of the current period, in accordance with Apple App Store policies. The renewal charge will be made to the User's Apple account within 24 hours prior to the expiration of the active period, in accordance with Apple App Store terms and conditions. The management of automatic renewal, including its timing, notifications, and processes, is controlled exclusively by Apple Inc. and is subject to their subscription policies. 3.3 Cancellation and Expiration The User can cancel their subscription at any time from their App Store account settings. To avoid automatic renewal, cancellation must be made at least 24 hours before the end of the current period. Cancellation, its effective timing, conditions, and refund policies are managed exclusively by Apple Inc. in accordance with their own App Store subscription policies. The Developer does not control or manage the cancellation process. Cancellation will take effect at the end of the current subscription period, without proportional refund for unused time, in accordance with standard Apple App Store policies. Upon expiration or cancellation of the subscription, the User will lose access to premium features (also called PRO) and will automatically revert to free user limitations, including: • Daily limits on image export. • Restrictions on simultaneous image selection. • Display of developer application promotions. The User may continue to use the basic features of the Application according to the limitations established for free users. 3.4 Purchase Restoration The User can restore their subscription on any Apple device linked to the same Apple ID used for the original purchase. Restoration is managed through the functionality provided by Apple App Store and allows the User to regain access to premium features without making a new payment, provided the subscription is active. 3.5 Plan Change The User can change between subscription plans (for example, from monthly to annual or vice versa) at any time from their App Store account settings. Plan changes, billing adjustments, and applicable credits are managed exclusively by Apple in accordance with their subscription policies. 3.6 Payment Processing All payments and renewals are managed exclusively through Apple App Store and are subject to Apple's Terms and Conditions. The Developer does not access, store, or process User payment data at any time. Prices may vary according to the User's country and are subject to applicable local taxes in accordance with Apple policies. 3.7 Refunds Refunds are subject exclusively to Apple's Refund Policy. The Developer does not process or manage refunds directly. To request a refund, the User must contact Apple through reportaproblem.apple.com. 4. LICENSE OF USE 4.1 License Grant The Developer grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Application on your personal iOS-compatible Apple devices, subject to compliance with these Terms, maintenance of an active subscription, and Apple App Store Usage Rules. The license includes personal and professional use of the Application, including its use to provide services to third parties in the course of the User's business (for example, professional photographers, graphic designers, marketing agencies). 4.2 Express Restrictions The following are expressly prohibited: • Copying, reproducing, modifying, distributing, selling, assigning, leasing, or sublicensing the Application or any part thereof. • Reverse engineering, decompiling, disassembling, or attempting to obtain the source code of the Application. • Creating derivative works based on the Application. • Circumventing, disabling, or interfering with the Application's licensing, subscription, or security systems. • Using the Application for any illegal purpose. • Using automated tools, bots, or scripts to interact with the Application. • Transferring the license to a third party. 5. USER CONTENT — MANDATORY RIGHTS DECLARATION 5.1 Exclusive and Non-Waivable User Responsibility THE USER IS SOLELY AND EXCLUSIVELY RESPONSIBLE, IN AN ABSOLUTE AND NON-WAIVABLE MANNER, FOR ENSURING THAT ALL ELEMENTS USED IN THE APPLICATION — INCLUDING WITHOUT LIMITATION: IMAGES AND ANY OTHER CONTENT — ARE THEIR PROPERTY OR HAVE EXPRESS AUTHORIZATION, VALID LICENSE, OR SUFFICIENT LEGAL PERMISSION FOR THEIR USE. This responsibility applies without exception to: • Images that the User selects to compress. • Any other visual element that the User introduces into the Application. THE DEVELOPER DOES NOT VERIFY, SUPERVISE, OR HAVE ACCESS TO ANY CONTENT USED BY THE USER IN THE APPLICATION. THE DEVELOPER IS A NEUTRAL TECHNICAL TOOL PROVIDER AND ASSUMES NO RESPONSIBILITY, DIRECT OR INDIRECT, ARISING FROM THE CONTENT THAT THE USER DECIDES TO PROCESS. 5.2 Ownership of Processed Content The User retains all rights to the content they process with the Application. The Developer does not claim, access, transfer, or use such content at any time. 5.3 Prohibited Content The User may not use the Application to process, create, or distribute content that: • Is illegal, defamatory, threatening, or incites hatred. • Violates privacy or image rights of third parties. • Infringes copyright or other intellectual property rights of third parties without authorization. • Constitutes child abuse or exploitation material (CSAM). • Is fraudulent, deceptive, or used for purposes of harassment or harm to third parties. The Developer reserves the right to suspend access to the Application in cases of use contrary to this section, without prejudice to corresponding legal actions. 5.4 Total Exemption of Developer Liability for User Content THE DEVELOPER IS TOTALLY AND EXPRESSLY EXEMPT FROM ANY LIABILITY — WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL — ARISING FROM: • The use of third-party intellectual property without authorization by the User. • Infringement of copyright or other intellectual property rights. • Claims, demands, or legal actions by third parties arising from content processed by the User. • Any damage, loss, or harm caused to third parties by the User's use of the Application. 6. LOCAL PROCESSING, PRIVACY, AND DATA 6.1 Exclusive On-Device Processing All images processed through the Application remain entirely on the User's device. The Application does not require an internet connection to operate its main functions and does not transmit images, thumbnails, metadata, processing results, or any other derived data to external servers. 6.2 No-Tracking Policy — Current Status and Future Changes In its current version, the Application does not collect, track, or transmit any personal User data. Stay Compress does not incorporate behavioral analysis systems, usage tracking, or user identifiers. The Developer reserves the right to incorporate third-party technical tools in future versions — such as error reporting systems or anonymous performance analysis — solely for the purpose of improving the stability and operation of the Application. In such case, the Developer will update the Privacy Policy prior to the implementation of such changes, and such data will always be anonymous and non-identifiable. Continued use of the Application after the update will constitute acceptance of the new terms. 6.3 Technical Data Through Apple Apple Inc. may collect anonymous technical data (error reports, performance statistics) through their own platforms (App Store Connect Analytics, TestFlight), in accordance with Apple's Privacy Policy. This data is managed exclusively by Apple and never reaches the Developer's servers. It does not include images or personally identifiable User information. 6.4 Storage, Backups, and Data Loss Compressed images generated with the Application are stored exclusively locally on the User's device until the User decides to export them to their photo gallery. The management, organization, and backup of such images is the exclusive responsibility of the User. The Developer does not perform, manage, or guarantee backups of any User content. During the compression process, the Application creates temporary files on the User's device that are automatically managed by the iOS operating system. The Developer is not responsible for the management, deletion, or loss of these temporary files. The User is solely and exclusively responsible for performing periodic backups of their content through iCloud, iTunes, or other solutions of their preference. The Developer assumes no responsibility for loss, damage, corruption, or inaccessibility of data caused by any reason, including: • Failures or breakdown of the User's device. • Installation of iOS updates, whether voluntary or automatic. • Installation of Application updates. • Uninstallation or reinstallation of the Application. • Factory reset or device restoration. • Incompatibilities with future versions of iOS or other system software. • Force majeure events or any other factor beyond the Developer's control. THE USER EXPRESSLY ACKNOWLEDGES AND ACCEPTS THAT THE USE OF THE APPLICATION AND THE STORAGE OF THEIR FILES IS AT THEIR OWN RISK, AND THAT THE DEVELOPER WILL NOT BE RESPONSIBLE IN ANY CASE FOR THE LOSS OF DATA OR FILES, REGARDLESS OF ITS CAUSE. 6.5 Device Permissions The Application will request access to the User's photo library exclusively to import images and save compressed results. This access operates according to the iOS permissions system and can be revoked at any time from the device Settings. Revocation of permissions may limit or prevent the use of essential Application features. 6.6 Promotions of Developer Applications The Application may display promotions for other applications developed by the same developer exclusively to users who do not have an active PRO subscription. These promotions are presented within the Application interface using Apple Inc.'s StoreKit technology. DISCLAIMER REGARDING PROMOTIONS: Each promoted application is an independent application with its own terms of use, privacy policy, functionalities, and business model. The developer assumes no responsibility for: • The accuracy, timeliness, or completeness of information displayed in promotions. • The continued availability of promoted applications on the App Store. • Changes, updates, or modifications to the features, functionalities, prices, or subscription models of promoted applications. • The compatibility of promoted applications with the User's device, operating system, or configuration. • Technical problems, errors, interruptions, or malfunctions in the display of promotions. • The User's experience when downloading, installing, configuring, or using promoted applications. • Any damage, loss, inconvenience, or expense arising from interaction with promotions or use of promoted applications. Promotions are displayed "as-is" and "as available," without warranties of any kind, whether express or implied. The User expressly acknowledges and accepts that: • The display of a promotion does not constitute a specific recommendation or guarantee by the Developer regarding the suitability of the application for the User's particular needs. • Each promoted application operates independently and is subject to its own terms of use and privacy policy that the User must review and accept independently. • The download, installation, and use of any promoted application is at the User's sole responsibility. • Promotions may contain errors or outdated information. • The Developer may suspend, modify, remove, or change promotions at any time without prior notice and without incurring any liability. For any inquiry or problem related to a promoted application, the User should contact the support of that application directly or Apple Inc. through the App Store. 7. METADATA MANAGEMENT The Application allows the User to manage metadata embedded in their images, including GPS data, date and time, camera information, EXIF data, orientation, color profile, and author information. THE USER IS SOLELY RESPONSIBLE FOR DECIDING WHICH METADATA TO PRESERVE OR REMOVE. The Developer assumes no responsibility for: • Deletion of metadata that the User later considers important. • Preservation of metadata that the User wishes to remove for privacy reasons. • Any consequence arising from the deletion or preservation of metadata, including loss of location, date, author, or copyright information. The User acknowledges that metadata deletion is irreversible once the compressed image has been exported and the original has been deleted. WARNING ABOUT THIRD-PARTY METADATA: The User is solely responsible for verifying that they have the legal right to delete or modify the metadata of the images they process, especially copyright, authorship, or copyright information. Removing copyright metadata from third-party images may facilitate illegal use of such images and constitute a violation of intellectual property rights. The Developer assumes no responsibility for the User's use of third-party images after removing their copyright or authorship metadata. 8. PROCESSING AND IMAGE QUALITY The Application allows the User to adjust the quality, resolution, and format of processed images. These adjustments are inherent to the operation of the Application and are part of the technical image compression process. THE DEVELOPER DOES NOT GUARANTEE THAT EXPORTED IMAGES WILL MAINTAIN THE SAME VISUAL QUALITY, DIMENSIONS, RESOLUTION, OR TECHNICAL CHARACTERISTICS AS THE ORIGINAL IMAGES. Image compression necessarily involves file size reduction that may result in visual quality loss, especially at high compression levels. The Application implements technical limits on the number of images that can be processed simultaneously to ensure stable operation of the Application. These limits are variable and may be modified by the Developer at any time without prior notice. The exact number of images that can be processed depends on multiple factors including device model, available memory, image size, and iOS version. The Developer does not guarantee a specific number of processable images. THE USER EXPRESSLY ACCEPTS THAT: • Image compression may result in visual quality loss. • Resolution reduction may result in images of smaller pixel size. • Conversion between formats (JPEG, PNG) may alter the visual characteristics of the image. • These effects are inherent to the nature of image compression and do not constitute a defect in the Application. The User is responsible for verifying the quality of compressed images before deleting the originals. Additionally, the Application implements technical limits on simultaneous image processing for the purpose of preserving device performance, avoiding memory failures, and preventing unexpected Application closures. These limits are necessary to ensure a stable experience and may vary according to device model and iOS version. The Developer reserves the right to adjust these limits in future updates without prior notice. 8.1 SPECIFIC WARNINGS ABOUT IMAGE COMPRESSION IRREVERSIBLE QUALITY LOSS: The User expressly acknowledges and accepts that image compression, especially in JPEG format, is an IRREVERSIBLE process that results in permanent quality loss. Once an image has been compressed, exported, and the original has been deleted, THERE IS NO TECHNICAL WAY to recover the original quality, resolution, or visual information. The Developer will not be responsible under any circumstances for quality loss or visual data resulting from compression. DIFFERENCES BETWEEN FORMATS: • JPEG: It is a LOSSY compression format. Size reduction is achieved through permanent elimination of visual information. Each time a JPEG image is compressed, quality is lost cumulatively and irreversibly. The Application reduces both quality and scale in JPEG format. • PNG: It is theoretically a LOSSLESS compression format, but the Application reduces size through scale (resolution) reduction, which results in detail loss. Compression quality does not affect PNG, only scale. SUPPORTED FORMATS: The Application is designed to process common image formats. Compatibility with all existing input formats is not guaranteed. Specialized formats (RAW, TIFF, HEIC with advanced features, HDR images, depth images, etc.) may not be supported, may be processed incorrectly, or may result in errors. The Developer assumes no responsibility for failures when processing non-standard or specialized formats. STATIC IMAGES ONLY: The Application processes exclusively static images. It DOES NOT process or support: • Live Photos (only the static image will be processed, losing the animation) • Videos or video clips • Animated GIFs (only the first frame will be processed) • Images with multiple layers or frames • Any multimedia content that is not a static image PREVIEWS AND COMPARISONS: Previews, before/after comparisons, and size estimates displayed in the Application are APPROXIMATE and may not accurately reflect the final result. Factors such as image content, visual complexity, and device limitations may cause variations between the preview and the exported result. The User must verify the final result before deleting the original images. COMPRESSION OPTIONS AS PREFERENCES: Compression options (quality, scale, maintain resolution, target size) are PREFERENCES, not absolute guarantees. The Application will attempt to achieve the specified parameters, but does not guarantee that: • The specified target size will be exactly achieved • The original resolution will be maintained when "maintain resolution" is selected • Quality settings will produce identical results on different images The final result depends on the specific content of each image and the technical limitations of the compression algorithm. COLOR PROFILES AND COLOR SPACE: Compression may alter, remove, or modify color profiles embedded in images (Adobe RGB, ProPhoto RGB, Display P3, etc.). Compressed images may be automatically converted to the standard sRGB color space, which may result in visual changes in colors, especially in images with wide color spaces. The Developer does not guarantee exact preservation of color profiles or specific color spaces. TRANSPARENCY IN PNG IMAGES: Perfect preservation of transparency (alpha channel) in PNG images is not guaranteed. Transparency may be lost, altered, or converted to solid color (white or black) depending on image content and compression process. The User must verify transparency in the final result before deleting the original. ORIENTATION NORMALIZATION: The Application automatically normalizes image orientation based on EXIF orientation metadata. This means that rotated images will be redrawn in their correct orientation and the orientation metadata will be set as "normal." This process may cause images to appear different in third-party applications that interpret orientation differently. The Developer assumes no responsibility for differences in how other applications display processed images. VISUAL ARTIFACTS: Aggressive compression, especially in JPEG format with low quality levels, may generate visual artifacts including: • Visible blocks or squares (blocking) • Pixelation or loss of detail • Blurred edges or halos around objects • Color banding in smooth gradients • Noise or "mosquito noise" around contrasted edges These artifacts are inherent to the JPEG compression algorithm and do not constitute a defect in the Application. The User is responsible for selecting appropriate compression levels for their use case. FILE SIZE LIMITS: There may be technical limits on the maximum file size that the Application can process, depending on the device's available memory, iPhone model, and iOS version. Extremely large images (for example, over 100MB or with resolutions over 50 megapixels) may cause failures, unexpected Application closures, or memory errors. The Developer does not guarantee successful processing of files of arbitrary size. TEMPORARY FILES AND BACKUPS: Images being compressed are stored as temporary files on the device and are NOT automatically included in iCloud or iTunes backups until they are exported to the photo gallery. If the device fails, is restored, or the Application closes unexpectedly during processing, these temporary files may be lost. The Developer assumes no responsibility for loss of unexported temporary files. CANCELLATION AND PROCESSING INTERRUPTION: If the User cancels image processing, closes the Application during the process, or the system interrupts the Application (for example, due to lack of memory or phone call), incomplete, corrupt, or partially processed files may result. The Developer assumes no responsibility for damaged files resulting from interruptions to the compression process. VARIATIONS BETWEEN DEVICES: Compression results, performance, processing speed, and Application capabilities may vary significantly between different iPhone models. Newer devices with more powerful processors and more RAM will produce faster results and will be able to process more images simultaneously. Older devices may experience severe limitations. The Developer does not guarantee consistent results between different device models. CHANGES IN COMPRESSION ALGORITHMS: The Developer reserves the right to modify, update, or replace the compression algorithms used by the Application in future updates. These changes may result in differences in quality, file size, or visual characteristics of compressed images compared to previous versions of the Application. The Developer does not guarantee consistency in compression results between different versions of the Application. 9. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY 9.1 No Warranties THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR CONTINUOUS AVAILABILITY. 9.2 Specific Exclusions of Liability The Developer does not warrant or assume responsibility for: • That the Application will function uninterrupted, error-free, or without defects. • That the results obtained will be accurate, satisfactory, or suitable for the User's intended use. • That the Application will be compatible with future versions of iOS or other operating systems. • Loss of data, device damage, or any consequence arising from the use of the Application. • Failures, delays, or interruptions caused by factors beyond the Developer's control. • The visual quality, resolution, or final appearance of exported images. • Quality loss inherent to the image compression process. • Deletion or preservation of metadata selected by the User. • Any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Application. • Commercial use that the User makes of images processed with the Application, including sale, distribution, licensing, or any economic exploitation of such images. • Partial or total failures in exporting multiple images simultaneously. The Developer does not guarantee that all images in a batch will be exported successfully, especially in large batches or on devices with limited resources. • The compatibility, display, or interpretation of compressed images by third-party applications, services, or platforms. • The content, functionality, quality, availability, or any aspect of promoted applications displayed within the Application. • Any damage, loss, or inconvenience arising from interaction with promotions or use of promoted applications. • The User's experience with promoted applications displayed within the Application, which operate independently. 9.3 Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER, ITS COLLABORATORS, LICENSORS, OR SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, REPUTATION, OR GOODWILL, REGARDLESS OF WHETHER SUCH LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY. The Developer's total and cumulative liability to the User for any claim related to the Application or these Terms shall be limited to the lesser of the following amounts: • (a) The total amount actually paid by the User to the Developer for subscription during the twelve (12) months prior to the event giving rise to the claim; or • (b) The sum of USD $10.00 (ten United States dollars). 10. FORCE MAJEURE The Developer shall not be liable for any delay, interruption, failure, or breach when caused by events beyond its reasonable control, including: • Natural disasters, earthquakes, floods, epidemics, or pandemics. • Acts of war, terrorism, civil unrest, or acts of government. • Interruptions, failures, or changes in Apple Inc.'s services, policies, or platforms, including App Store, iCloud, or iOS updates. • Widespread failures of internet or telecommunications infrastructure. • Cyber attacks, malware, or unauthorized access to third-party systems. • Changes in legislation, government regulations, or court rulings. The occurrence of a Force Majeure Event shall not entitle the User to refund, compensation, or indemnification of any kind. 11. WAIVER OF CLASS ACTIONS To the maximum extent permitted by applicable law, THE USER EXPRESSLY WAIVES THEIR RIGHT TO INITIATE, PARTICIPATE IN, OR JOIN ANY CLASS ACTION, CONSOLIDATED LAWSUIT, OR REPRESENTATIVE PROCEEDING AGAINST THE DEVELOPER, WHETHER IN COURT OR ARBITRATION. Any claim must be brought by the User individually and exclusively. If this waiver is declared inapplicable with respect to a specific claim, such claim must be processed individually, without affecting the validity of this waiver with respect to others. 12. TIME LIMITATION FOR FILING CLAIMS To the maximum extent permitted by applicable law, without prejudice to the statute of limitations established by Bolivian law, THE USER AGREES THAT ANY CLAIM, LEGAL ACTION, OR LAWSUIT ARISING FROM THE USE OF THE APPLICATION OR THESE TERMS MUST BE FILED WITHIN SIX (6) MONTHS FOLLOWING THE DATE ON WHICH THE USER BECAME AWARE, OR REASONABLY SHOULD HAVE BECOME AWARE, OF THE FACT GIVING RISE TO THE CLAIM. After such period, the claim shall be time-barred and the User irrevocably waives any right to file it subsequently, to the extent permitted by law. This limitation applies to any type of claim, whether contractual, non-contractual, or of any other nature. 13. INDEMNIFICATION The User agrees to defend, indemnify, and hold harmless the Developer, its collaborators, employees, agents, and licensors, from and against any claim, damage, loss, liability, cost, and expense (including reasonable attorneys' fees) arising from or related to: • The User's use of the Application. • The User's violation of these Terms. • Any content that the User processes or distributes through the Application in infringement of third-party intellectual property rights. • Any violation of applicable laws committed by the User. • Any third-party claim arising from metadata deletion (including author or copyright information) performed by the User. This indemnification obligation shall survive the termination of these Terms and the cessation of the User's use of the Application. 14. INTELLECTUAL PROPERTY OF THE APPLICATION The Application, including its source code, visual design, logos, trade name "Stay Compress," user interfaces, and documentation, is the exclusive property of the Developer and is protected by the intellectual property laws of Bolivia and applicable international treaties. These Terms do not transfer or assign to the User any intellectual property rights over the Application. The User may not use the Developer's trademarks, names, or logos without prior written consent. 15. AVAILABILITY AND MODIFICATIONS OF THE APPLICATION The Developer may, at any time and at its sole discretion, release updates that modify, expand, or remove features, or discontinue the Application temporarily or permanently, with or without prior notice. The Developer shall not be liable to the User or third parties for any modification, suspension, or interruption of the Application's availability. 16. TERMINATION The User may terminate this agreement at any time by canceling their active subscription and uninstalling the Application from their device. Subscription cancellation does not entitle to proportional refund for the unused period. The Developer may suspend or cancel the license of use immediately, with or without prior notice, if the User violates these Terms or uses the Application fraudulently or illegally. Upon termination, provisions regarding intellectual property, limitation of liability, indemnification, waiver of class actions, time limitation of claims, and applicable law shall remain in effect. 17. TECHNICAL REQUIREMENTS The Application requires iOS 17.0 or higher to function. The Application's performance depends on the User's device hardware capabilities, including processor, RAM, and available storage space. Older devices may experience slower processing, limitations on the number of images that can be processed simultaneously, or restrictions on certain features. Compression of high-resolution images may require significant processing time, consume device resources (including battery and memory), and occupy temporary storage space. The User acknowledges that these factors are inherent to the nature of image processing and do not constitute a defect in the Application. The Developer does not guarantee compatibility with all iPhone models or future versions of iOS. 18. COMPLIANCE WITH APPLE (EULA) 18.1 Support and Maintenance The Developer is solely and exclusively responsible for providing technical support and maintenance for the Application. Apple Inc. has no obligation to provide maintenance services, technical support, or updates related to the Application. 18.2 Legal Compliance — Export By using the Application, the User represents and warrants that: (a) they are not located in a country subject to embargo by the government of the United States of America or designated as a "State sponsor of terrorism"; and (b) they are not listed on any prohibited or restricted parties list of the government of the United States of America. 18.3 Apple as Third-Party Beneficiary The User expressly acknowledges and accepts that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms of Use and have the right to enforce them directly against the User. Apple Inc. is not a party to these Terms and assumes no responsibility for the Application. 19. JURISDICTION AND APPLICABLE LAW These Terms are governed by and interpreted in accordance with the laws of the Plurinational State of Bolivia, without regard to its conflict of laws provisions. Any dispute shall be submitted, first, to a good faith direct negotiation process between the parties for a minimum period of thirty (30) days. If no agreement is reached, to the maximum extent permitted by applicable law, the dispute shall be resolved by the competent courts of the city of Cochabamba, Bolivia, to whose jurisdiction the parties expressly submit. 20. MODIFICATIONS TO THE TERMS The Developer reserves the right to modify these Terms at any time. Modifications will be notified through an Application update on the App Store and/or publication on the official website. Continued use of the Application after the effective date of the modified Terms constitutes acceptance of such changes. If you do not agree with the changes, you must stop using the Application before the effective date of the modifications. 21. SEVERABILITY AND WAIVER If any provision of these Terms is declared invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect. The Developer's failure to exercise any right or provision of these Terms shall not constitute a waiver of such right, except by written acknowledgment and agreement of the Developer. 22. OFFICIAL LANGUAGE These Terms have been originally written in Spanish, which constitutes the official and authentic version. Any translation is provided solely for the User's convenience. In case of conflict between the Spanish version and any translation, the Spanish version shall prevail in all cases and shall be the only one with binding legal value. The User acknowledges having had access to the Spanish version and accepts that such version governs their relationship with the Developer. FINAL ACKNOWLEDGMENT: BY USING STAY COMPRESS, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE TERMS OF USE IN THEIR ENTIRETY.
