IMPORTANT NOTICE: BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THIS APP, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE WITH ANY OF THEM, DO NOT USE THE APP.
1. ACCEPTANCE OF TERMS
By downloading, installing, accessing, or using Portrait Lens Cinematic Selfie ("the App"), you ("the User") agree to be legally bound by these Terms of Use ("the Terms"), including the Privacy Policy available at https://stayarts.com/cinematicselfie/privacy. If you do not agree with any of these terms, do not use the App. Continued use following any update to the Terms constitutes your acceptance of such changes.
These Terms constitute the entire agreement between you and the Developer with respect to the App, and supersede any prior verbal or written agreements.
Notwithstanding the foregoing, nothing in these Terms limits any rights the User may have under the consumer protection laws of their country of residence that cannot be waived by contract.
2. DESCRIPTION OF SERVICE
Portrait Lens Cinematic Selfie is a video processing application for iOS that allows the User to apply cinematic blur effects to the background of their videos, keeping people in focus. The App uses native operating system tools to detect people in the video and apply the blur effect to the background of each frame.
The App operates exclusively through local processing on the User's device. The App does NOT transmit, collect, or store on external servers any video, personal data, or metadata of the User. All processing occurs entirely on your device.
Any technical data collected by Apple Inc. through its platforms is managed exclusively by Apple in accordance with its own policies, and does not reach the Developer's servers under any circumstances.
The Developer reserves the right to modify, suspend, or discontinue any functionality of the App at any time, with or without prior notice, without incurring any liability to the User.
3. SUBSCRIPTION
3.1 Subscription Plans and Features
The App allows the User to import videos, adjust blur and edge-smoothing parameters, preview the applied effect, and generate short samples of the processed video without a subscription. However, exporting the full processed video to the photo gallery requires an active subscription.
The Developer offers monthly and annual subscription plans whose prices are displayed in the App Store based on the User's region at the time of purchase. The Developer reserves the right to modify subscription plan prices at any time in accordance with Apple's policies. The price in effect at the time of subscription applies until the next renewal.
3.2 Free Usage Model
The App allows users without an active subscription (free users) to use the full video processing experience with a daily export limit. Free users can export a limited number of processed videos per day. The daily limit applies only to successful exports and resets at midnight in the user's local time zone.
Free users can:
• Import videos and preview the cinematic portrait effect in real-time
• Generate short samples of the processed video
• Adjust blur intensity and edge smoothing settings
• Export a limited number of processed videos per day to their photo library
PRO subscribers (users with an active subscription) have unlimited exports and do not see promotional content.
The daily export count is stored locally on the User's device using the iOS Keychain to ensure reliability across app launches and reinstalls. This storage contains only the current date and export count, with no personal information, user identity, media metadata, or identifiable information of any kind.
The Developer reserves the right to modify the daily export limit for free users at any time without prior notice.
3.3 Automatic Renewal
Subscriptions automatically renew at the end of each period (monthly or annual), unless the User cancels at least 24 hours before the end of the current period. The renewal charge will be applied to the User's Apple account within 24 hours prior to the expiration of the active period.
3.4 Cancellation and Expiration
The User may cancel their subscription at any time from their App Store account settings. Cancellation takes effect at the end of the current subscription period, with no proportional refund for unused time.
Upon expiration or cancellation of the subscription, the User will lose access to premium features (also referred to as PRO), specifically the ability to export full processed videos without daily limits. The User may continue to use the App's other features to import, preview, and adjust effects, and may export videos subject to the free daily limit. Videos previously exported and saved to the User's device will remain accessible.
3.5 Restore Purchases
The User may restore their subscription on any Apple device linked to the same Apple ID used for the original purchase. Restoration is managed through the functionality provided by Apple App Store and allows the User to regain access to premium features without making a new payment, provided the subscription is active.
3.6 Plan Changes
The User may switch between subscription plans (e.g., from monthly to annual or vice versa) at any time from their App Store account settings. Plan changes, billing adjustments, and applicable credits are managed exclusively by Apple in accordance with its subscription policies.
3.7 Payment Processing
All payments and renewals are managed exclusively through Apple App Store and are subject to Apple's Terms and Conditions. The Developer does not access, store, or process the User's payment data at any time. Prices may vary by country and are subject to applicable local taxes in accordance with Apple's policies.
3.8 Refunds
Refunds are subject exclusively to Apple's Refund Policy. The Developer does not process or manage refunds directly. To request a refund, the User must contact Apple at reportaproblem.apple.com.
3.9 In-App Promotional Content
The App may display promotional content for other applications published by the same Developer. These promotions are shown exclusively to users who do not have an active subscription (free users). Users with an active PRO subscription do not see promotional content.
Promotional Implementation:
• All promotional content is implemented using Apple's native StoreKit APIs provided by the iOS operating system.
• Promotions are for the Developer's own applications only. No third-party advertising networks, third-party ad SDKs, external ad mediation platforms, or behavioral tracking systems are used.
• The promotional content is displayed through Apple's App Store interface and is subject to Apple's own terms and policies.
User Experience:
• Promotional content is designed not to block or interfere with the App's core functionality.
• Users can dismiss promotional content at any time.
• Users can continue using the App normally regardless of promotional content.
• The App remains fully functional whether or not the User interacts with promotional content.
Modifications:
• The Developer reserves the right to modify, add, remove, or change the format, frequency, placement, timing, duration, and presentation method of promotional content at any time without prior notice.
• The Developer may introduce additional promotional placements, formats, or methods in future updates, always using Apple's official APIs.
• The Developer may change which applications are promoted, how often promotions appear, and where they are displayed within the App at any time.
Independence of Promoted Applications:
• Each promoted application is an independent product with its own functionality, features, purpose, and development.
• Each promoted application has its own Terms of Use, Privacy Policy, subscription model, pricing, and legal framework, which are separate and independent from this App.
• Downloading, installing, or using a promoted application is entirely voluntary and subject to that application's own terms and conditions.
• The User is solely responsible for reviewing and accepting the terms, privacy policies, and any other legal documents of any promoted application before downloading or using it.
Disclaimer of Liability for Promoted Applications:
• THE DEVELOPER IS NOT RESPONSIBLE FOR THE FUNCTIONALITY, PERFORMANCE, CONTENT, QUALITY, AVAILABILITY, ACCURACY, RELIABILITY, SECURITY, OR ANY OTHER ASPECT OF THE PROMOTED APPLICATIONS.
• THE DEVELOPER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE PROMOTED APPLICATIONS, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
• Any issues, claims, complaints, technical problems, billing disputes, refund requests, or concerns related to a promoted application must be addressed directly with that application's own support channels and are governed exclusively by that application's own terms and policies.
• The Developer shall not be liable for any damages, losses, costs, or expenses arising from the User's download, installation, use, or inability to use any promoted application.
• The User expressly acknowledges and agrees that the display of promotional content does not constitute an endorsement, guarantee, or warranty of any kind regarding the promoted applications.
4. LICENSE TO USE
4.1 License Grant
The Developer grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the App on your compatible personal Apple iOS devices, subject to compliance with these Terms, maintenance of an active subscription for premium features, and Apple App Store's Usage Rules.
The license includes personal and professional use of the App, including its use to provide services to third parties in the course of the User's business activities.
4.2 Express Restrictions
The following are expressly prohibited:
• Copying, reproducing, modifying, distributing, selling, assigning, leasing, or sublicensing the App or any part of it.
• Reverse engineering, decompiling, disassembling, or attempting to obtain the source code of the App.
• Creating derivative works based on the App.
• Circumventing, disabling, or interfering with the App's licensing, subscription, or security systems.
• Using the App for any illegal purpose.
• Using automated tools, bots, or scripts to interact with the App.
• Transferring the license to a third party.
5. USER CONTENT — MANDATORY RIGHTS DECLARATION
5.1 Exclusive and Non-Waivable User Responsibility
THE USER IS THE SOLE AND EXCLUSIVE RESPONSIBLE PARTY, IN AN ABSOLUTE AND NON-WAIVABLE MANNER, FOR ENSURING THAT ALL ELEMENTS USED IN THE APP — INCLUDING WITHOUT LIMITATION: VIDEOS, RECORDINGS, IMAGES, AND ANY OTHER AUDIOVISUAL CONTENT — ARE OWNED BY THE USER OR HAVE EXPRESS AUTHORIZATION, VALID LICENSE, OR SUFFICIENT LEGAL PERMISSION FOR THEIR USE.
This responsibility applies without exception to:
• Videos imported by the User for processing.
• Image rights of all persons appearing in such videos.
• Copyright over music, audio, or any other sound elements contained in the videos.
• Any other visual or audio element present in the processed content.
THE DEVELOPER DOES NOT VERIFY, MONITOR, OR HAVE ACCESS TO ANY CONTENT USED BY THE USER IN THE APP. THE DEVELOPER IS A NEUTRAL TECHNICAL TOOL PROVIDER AND ASSUMES NO LIABILITY, DIRECT OR INDIRECT, ARISING FROM THE CONTENT THE USER CHOOSES TO PROCESS.
5.2 Ownership of Processed Content
The User retains all rights over the content they process with the App. The Developer does not claim, access, transfer, or use such content at any time.
5.3 Consent of Persons Appearing in Videos
Since the App processes videos that may contain images of persons, the User expressly represents and warrants that they have obtained the valid, free, and informed consent of all persons appearing in the videos they process with the App, or that such consent is not legally required in the specific context of use.
THE DEVELOPER SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR THE PROCESSING OF VIDEOS CONTAINING IMAGES OF PERSONS WITHOUT THEIR CONSENT, NOR FOR THE LEGAL, CIVIL, OR CRIMINAL CONSEQUENCES THAT SUCH USE MAY GENERATE FOR THE USER OR THIRD PARTIES.
5.4 Prohibited Content
The User may not use the App to process, create, or distribute content that:
• Is illegal, defamatory, threatening, or incites hatred.
• Violates the privacy or image rights of third parties.
• Infringes copyrights, trademarks, or other intellectual property rights of third parties without authorization.
• Constitutes child sexual abuse material (CSAM).
• Is fraudulent, deceptive, or used for the purpose of harassing or harming third parties.
• Processes images of persons without their consent with the intent to distribute, publish, or use such content in a manner that violates their privacy, dignity, or rights.
The Developer reserves the right to suspend access to the App for uses contrary to this section, without prejudice to any applicable legal action.
5.5 Full Disclaimer of Developer Liability for User Content
THE DEVELOPER IS FULLY AND EXPRESSLY EXEMPT FROM ANY LIABILITY — WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL — ARISING FROM:
• The User's unauthorized use of third-party intellectual property.
• Infringement of copyrights, image rights, trademarks, or any other intellectual property rights.
• Claims, demands, or legal actions by third parties arising from content processed by the User.
• Any damage, loss, or harm caused to third parties by the User's use of the App.
• The processing of videos containing images of persons without their consent.
6. VIDEO PROCESSING, QUALITY, AND PERFORMANCE
6.1 Nature of Processing and Variable Results
The App uses automated operating system tools to detect persons in video frames and apply the blur effect to the background. This technology produces results that may vary depending on video conditions, lighting, recording angle, scene complexity, number of persons present, and other factors outside the Developer's control.
Additionally, results may vary between different versions of the App or the device's operating system, as the system tools on which the App relies may be updated by Apple at any time without the Developer's involvement. The Developer has no control over such updates or their impact on the App's results.
THE USER EXPRESSLY ACKNOWLEDGES THAT NO PRIOR VERSION OF THE APP NOR ANY PREVIOUSLY OBTAINED RESULT GUARANTEES IDENTICAL RESULTS IN THE FUTURE, AND THAT SUCH VARIATIONS DO NOT CONSTITUTE A DEFECT NOR GIVE RISE TO ANY CLAIM.
6.2 Processing Limitations
THE DEVELOPER DOES NOT GUARANTEE:
• That person detection will be perfect, complete, or accurate in all frames or conditions.
• That the blur effect will produce results identical to those of professional recording equipment.
• That the exported video will maintain the same technical characteristics as the original video.
• That processing will complete within a specific time, as it depends on the device, video duration, and selected settings.
• That the User's device will not experience overheating, high battery consumption, or slowdowns during processing.
• That the results will be suitable for any specific use, whether personal, professional, or commercial.
THE USER EXPRESSLY ACKNOWLEDGES THAT VARIATIONS IN PROCESSING QUALITY, TECHNICAL ADJUSTMENTS INHERENT TO THE APP'S OPERATION, AND PERFORMANCE LIMITATIONS DO NOT CONSTITUTE A DEFECT OF THE APP AND DO NOT GIVE RISE TO ANY CLAIM OR COMPENSATION.
6.3 Express Assumption of Risk for Imperfect Results
THE USER EXPRESSLY ACKNOWLEDGES AND ACCEPTS THAT:
• Automatic person detection is a technology with inherent limitations that may produce imperfect, partial, or incorrect results under certain conditions, regardless of the App's correct functioning.
• By using the App, the User voluntarily, knowingly, and irrevocably assumes the risk of obtaining results that do not meet their expectations, including incorrect detections, imprecise edges, frames without effect, or any other imperfection in the final result.
• Imperfect results arising from the inherent limitations of detection technology do not constitute a defect of the App, a breach of these Terms, and do not entitle the User to any claim, compensation, refund, or legal action of any kind against the Developer.
THE USER DECLARES HAVING UNDERSTOOD AND ACCEPTED THESE LIMITATIONS BEFORE USING THE APP AND BEFORE PURCHASING ANY SUBSCRIPTION.
6.4 Device Resource Usage and Temporary Files
Video processing requires intensive use of device resources. The App implements optimizations to maximize performance, but the final result depends on the User's hardware capabilities. Older devices may experience slower processing, resolution limitations, or unexpected closures due to insufficient resources.
During processing, the App generates temporary files in the device's internal storage. If processing is interrupted for any reason — including incoming calls, low battery, forced App closure, or any other cause — such temporary files may remain on the device occupying storage space. The Developer is not responsible for the storage space consumed by these temporary files or for their deletion. The User is solely responsible for managing their device's storage.
6.5 Disclaimer of Liability for Professional or Commercial Use
The App is a general-purpose tool. The Developer does not guarantee that the results are suitable for any professional, commercial, editorial, advertising, cinematographic, or any other use that implies specific quality expectations or generates economic income for the User.
THE DEVELOPER SHALL NOT BE LIABLE, UNDER ANY CIRCUMSTANCES, FOR ECONOMIC LOSSES, LOST PROFITS, LOSS OF BUSINESS OPPORTUNITIES, DAMAGE TO PROFESSIONAL REPUTATION, OR ANY OTHER DIRECT OR INDIRECT ECONOMIC HARM THAT THE USER MAY SUFFER AS A RESULT OF USING THE APP IN PROFESSIONAL OR COMMERCIAL CONTEXTS, REGARDLESS OF WHETHER THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
7. LOCAL PROCESSING, PRIVACY, AND DATA
7.1 Exclusive On-Device Processing
All video processed through the App remains entirely on the User's device. The App does not require an internet connection to operate its core features and does not transmit videos, frames, metadata, processing results, or any other derived data to external servers.
7.2 No-Tracking Policy — Current Status and Future Changes
In its current version, the App does not collect, track, or transmit any personal data of the User. Portrait Lens Cinematic Selfie does not incorporate behavioral analytics systems, usage tracking, or user identifiers.
The Developer reserves the right to incorporate in future versions third-party technical tools — such as anonymous error reporting or performance analytics systems — solely for the purpose of improving the App's stability and functionality. In such case, the Developer will update the Privacy Policy prior to the implementation of such changes, and such data will always be anonymous and non-identifiable. Continued use of the App after the update will constitute acceptance of the new terms.
7.3 Technical Data Through Apple
When using the App, the User interacts with Apple Inc. platforms that operate independently from the Developer. Apple may collect anonymous technical data through the App Store and its associated services — including aggregated usage statistics and technical system reports — in accordance with Apple's Privacy Policy (apple.com/privacy). This data is managed exclusively by Apple, does not include videos or personally identifiable information of the User, and does not reach the Developer's servers under any circumstances. The Developer may only access aggregated and anonymous statistics through the tools Apple makes available to developers, without the ability to identify any individual user.
7.4 Storage, Backups, and Data Loss
Videos processed with the App are saved to the User's device photo library. The management, organization, and backup of such files is the exclusive responsibility of the User. The Developer does not perform, manage, or guarantee backups of any User content.
The User is solely and exclusively responsible for performing periodic backups of their content using iCloud, iTunes, or other solutions of their choice.
The Developer assumes no liability for the loss, damage, corruption, or inaccessibility of data arising from any cause, including:
• Failure or malfunction of the User's device.
• Installation of iOS updates, whether voluntary or automatic.
• Installation of App updates.
• Uninstallation or reinstallation of the App.
• Factory reset or device restoration.
• Incompatibilities with future versions of iOS or other system software.
• Force majeure events or any other factor outside the Developer's control.
THE USER EXPRESSLY ACKNOWLEDGES AND ACCEPTS THAT USE OF THE APP AND STORAGE OF FILES IS AT THEIR OWN RISK, AND THAT THE DEVELOPER SHALL NOT BE LIABLE IN ANY CASE FOR THE LOSS OF DATA OR FILES, REGARDLESS OF CAUSE.
7.5 Device Permissions
The App will request access to the User's photo library exclusively to import videos and save processed videos. This access operates in accordance with iOS's permission system and may be revoked at any time from the device's Settings. Revoking permissions may limit or prevent the use of essential App features.
8. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
8.1 No Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR CONTINUOUS AVAILABILITY.
8.2 Specific Liability Exclusions
The Developer does not warrant or assume liability for:
• The App operating without interruption, free of errors, or without defects.
• The results obtained being accurate, satisfactory, or suitable for the User's intended use.
• Person segmentation functioning correctly under all lighting conditions, angles, or scene complexity.
• The App being compatible with future versions of iOS or other operating systems.
• Data loss, device damage, or any consequence arising from the use of the App.
• Failures, delays, or interruptions caused by factors outside the Developer's control.
• The visual quality, resolution, or final appearance of exported videos.
• Battery consumption, device overheating, or memory usage during processing.
• Any direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the App.
8.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER, ITS COLLABORATORS, LICENSORS, OR SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, NOR FOR LOSS OF PROFITS, DATA, REPUTATION, OR GOODWILL, REGARDLESS OF WHETHER SUCH LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.
The Developer's total and cumulative liability to the User for any claim related to the App or these Terms shall be limited to the lesser of the following amounts:
• (a) The total amount actually paid by the User to the Developer for subscription during the twelve (12) months preceding the event giving rise to the claim; or
• (b) The sum of USD $10.00 (ten United States dollars).
9. FORCE MAJEURE
The Developer shall not be liable for any delay, interruption, failure, or non-performance when caused by events outside its reasonable control, including:
• Natural disasters, earthquakes, floods, epidemics, or pandemics.
• Acts of war, terrorism, civil unrest, or government actions.
• Interruptions, failures, or changes in Apple Inc.'s services, policies, or platforms, including the App Store, iCloud, or iOS updates.
• Widespread internet or telecommunications infrastructure failures.
• Cyberattacks, malware, or unauthorized access to third-party systems.
• Changes in legislation, government regulations, or judicial rulings.
The occurrence of a Force Majeure Event shall not entitle the User to any refund, compensation, or indemnification of any kind.
10. CLASS ACTION WAIVER
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE USER EXPRESSLY WAIVES THEIR RIGHT TO INITIATE, PARTICIPATE IN, OR JOIN ANY CLASS ACTION LAWSUIT, CONSOLIDATED CLAIM, OR REPRESENTATIVE PROCEEDING AGAINST THE DEVELOPER, WHETHER IN COURT OR ARBITRATION.
Any claim must be brought by the User on an individual and exclusive basis. If this waiver is found unenforceable with respect to a specific claim, that claim must be handled individually, without affecting the validity of this waiver with respect to all other claims.
11. TIME LIMITATION FOR CLAIMS
WITHOUT PREJUDICE TO THE STATUTES OF LIMITATIONS ESTABLISHED BY BOLIVIAN LAW, AND TO THE MAXIMUM EXTENT PERMITTED BY SUCH LAW, THE USER AGREES THAT ANY CLAIM, LEGAL ACTION, OR DEMAND ARISING FROM THE USE OF THE APP OR THESE TERMS MUST BE FILED WITHIN SIX (6) MONTHS FOLLOWING THE DATE ON WHICH THE USER KNEW, OR REASONABLY SHOULD HAVE KNOWN, OF THE EVENT GIVING RISE TO THE CLAIM.
After such period, the claim shall be time-barred and the User irrevocably waives any right to file it thereafter, to the extent permitted by law. This limitation applies to any type of claim, whether contractual, tortious, or of any other nature.
12. INDEMNIFICATION
The User agrees to defend, indemnify, and hold harmless the Developer, its collaborators, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
• The User's use of the App.
• The User's violation of these Terms.
• Any content the User processes or distributes through the App in infringement of third-party intellectual property rights or image rights.
• Any violation of applicable laws committed by the User.
This indemnification obligation shall survive the termination of these Terms and the User's cessation of use of the App.
13. INTELLECTUAL PROPERTY OF THE APP
The App, including its source code, visual design, logos, trade name "Portrait Lens Cinematic Selfie," user interfaces, and documentation, is the exclusive property of the Developer and is protected by Bolivia's intellectual property laws and applicable international treaties.
These Terms do not transfer or assign to the User any intellectual property rights over the App. The User may not use the Developer's trademarks, names, or logos without prior written consent.
14. AVAILABILITY, MODIFICATIONS, AND DISCONTINUATION OF THE APP
The Developer may, at any time and at its sole discretion, release updates that modify, expand, or remove features, or discontinue the App temporarily or permanently, with or without prior notice.
The availability of the App in the App Store also depends on Apple Inc.'s policies, decisions, and conditions, which are outside the Developer's control. If Apple removes the App from the store, restricts its distribution in certain regions, modifies its policies in a way that affects the App's functionality, or makes changes to its platform that prevent the App from functioning correctly, the Developer shall not be liable to the User or any third party for such circumstances, and the User shall have no right to any refund, compensation, or indemnification of any kind as a result.
Likewise, the operating system tools on which the App relies for video processing may be modified, updated, or discontinued by Apple at any time. If such changes affect the App's functionality or the quality of its results, the Developer shall have no obligation to update the App within any specific timeframe or to maintain the same results as prior versions.
The Developer shall not be liable to the User or any third party for any modification, suspension, interruption, or discontinuation of the App's availability, regardless of cause.
15. TERMINATION
The User may terminate this agreement at any time by canceling their active subscription and uninstalling the App from their device. Cancellation of the subscription does not entitle the User to a proportional refund for the unused period.
The Developer may suspend or cancel the license to use immediately, with or without prior notice, if the User violates these Terms or uses the App in a fraudulent or illegal manner.
Upon termination, the provisions regarding intellectual property, limitation of liability, indemnification, class action waiver, time limitation for claims, and governing law shall remain in full force and effect.
16. TECHNICAL REQUIREMENTS
The App's performance depends on the User's device capabilities. Video processing is an intensive operation that requires a device with sufficient capacity. Older devices may experience slower processing, higher battery consumption, device overheating, or limitations in certain features. The Developer does not guarantee compatibility with all device models or future versions of the operating system.
17. APPLE COMPLIANCE (EULA)
17.1 Support and Maintenance
The Developer is the sole and exclusive party responsible for providing technical support and maintenance for the App. Apple Inc. has no obligation to provide maintenance, technical support, or updates related to the App.
17.2 Legal Compliance — Export
By using the App, the User represents and warrants that: (a) they are not located in a country subject to embargo by the United States government or designated as a "terrorist-sponsoring state"; and (b) they are not listed on any prohibited or restricted parties list of the United States government.
17.3 Apple as Third-Party Beneficiary
The User expressly acknowledges and agrees that Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms of Use and have the right to enforce them directly against the User. Apple Inc. is not a party to these Terms and assumes no liability for the App.
18. JURISDICTION AND GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of the Plurinational State of Bolivia, without regard to its conflict of law provisions. Any dispute shall first be submitted to a direct good-faith negotiation process between the parties for a minimum period of thirty (30) days. If no agreement is reached, the dispute shall be resolved by the competent courts of the city of Cochabamba, Bolivia, to whose jurisdiction the parties expressly submit.
19. MODIFICATIONS TO THE TERMS
The Developer reserves the right to modify these Terms at any time. Modifications will be communicated through an App update in the App Store and/or publication on the official website. Continued use of the App after the effective date of the modified Terms constitutes acceptance of such changes.
If you do not agree with the changes, you must stop using the App before the effective date of the modifications.
20. SEVERABILITY AND WAIVER
If any provision of these Terms is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
The Developer's failure to exercise any right or provision of these Terms shall not constitute a waiver of such right, unless acknowledged and agreed to in writing by the Developer.

22. OFFICIAL LANGUAGE
These Terms were originally drafted in Spanish, which constitutes the official and authentic version. Any translation is provided solely for the User's convenience.
In the event of any conflict between the Spanish version and any translation, the Spanish version shall prevail in all cases and shall be the only version with legally binding effect.
The User acknowledges having had access to the Spanish version and agrees that such version governs their relationship with the Developer.
